Terms & Conditions¶
Draft: not yet reviewed by an attorney
This page is a starting-point draft, written to plainly describe how Frogge actually works. It has not been reviewed by a licensed attorney and should not be treated as final or legally binding until it has. Have a lawyer review this before linking it anywhere it could be relied on (Discord's application listing, the Dashboard's sign-in flow, an actual Terms acceptance gate, etc.), and update the effective date below once it's been reviewed and adopted.
Effective date: (set once reviewed and adopted)
1. Agreement to these Terms¶
These Terms & Conditions ("Terms") govern your use of Frogge: the Discord bot, the web Dashboard, the FroggePlugin in-game companion, and the background services that support them (together, the "Service"). By adding Frogge to a Discord server, signing into the Dashboard, or using the Plugin, you agree to these Terms. If you're doing so on behalf of a Discord server or organization, you're confirming you have the authority to agree on its behalf.
If you don't agree, don't use the Service.
2. What Frogge is¶
Frogge is a set of tools for running an FFXIV roleplay venue on Discord: staffing, events, VIP membership, character profiles, and related venue-management features, described in full on the Features pages. It is an independent, fan-made project and is not affiliated with, endorsed by, or sponsored by Discord Inc. or Square Enix, including FINAL FANTASY XIV. Use of the Plugin, which relies on the third-party Dalamud framework to interact with the game client, is done at your own risk with respect to FINAL FANTASY XIV's own terms of service and user agreements, which Frogge does not control and cannot guarantee compliance with.
3. Eligibility¶
You must meet Discord's own minimum age requirement to use Discord at all, and by using Frogge through Discord, you're also agreeing to Discord's Terms of Service and Community Guidelines. Frogge does not knowingly collect information from anyone below that minimum age. See Privacy Policy for more.
4. Accounts and access¶
Frogge has no account system of its own. Your identity within the Service is your Discord account, and Dashboard access is granted by signing in with Discord. Server (venue) administration is governed by Discord's own permissions plus Frogge's own configurable Admin Access list; see Permissions.
5. Acceptable use¶
You agree not to use the Service to:
- Violate Discord's Terms of Service, Community Guidelines, or any applicable law.
- Upload, post, or store content you don't have the right to use, or content that's illegal, harassing, hateful, or sexually exploitative of minors.
- Attempt to disrupt, overload, or gain unauthorized access to the Service, its infrastructure, or other users' data.
- Reverse engineer, scrape, or automate interactions with the Service outside of its intended interfaces.
- Exploit bugs or unintended behavior for advantage rather than reporting them.
We may suspend or remove access to the Service, for a single server or a specific user, for violating these Terms.
6. Your content¶
Frogge stores content you and your members create through it: RP character profiles, event and shift details, custom embeds, form responses, financial records you log, and images you upload, among other things (see Privacy Policy for the full picture). You retain ownership of what you create. By submitting it, you grant Frogge the license needed to store, process, and display it back to you and (where a feature is designed to, like a posted event announcement or a public character profile) to other members, solely to operate the Service. You're responsible for having the rights to anything you upload, including images.
Some roleplay content, by its nature, can be mature or NSFW; several Frogge features (Profiles, Cards) include NSFW flagging/spoilering for this reason. You're responsible for configuring these appropriately for your community and for complying with Discord's own rules on age-restricted content.
7. VIP membership and subscriptions¶
Frogge's own VIP module is a record-keeping and Discord-role-automation tool for your venue's membership program; Frogge does not process payments for your venue's VIP program and isn't a party to transactions between you and your members.
Separately, a Frogge venue itself may have a free or premium subscription tier (see Free vs. Premium). Where billing for that exists, it's handled through Discord's own subscription/monetization systems, not by Frogge directly. Frogge never sees or stores your payment card details. Refunds, cancellations, and billing disputes for a Frogge subscription are governed by Discord's own terms for that purchase.
8. Service availability¶
Frogge is actively developed software provided on an as-available basis. Features may change, and the Service may be unavailable for maintenance, incidents, or Discord/third-party outages outside our control. We don't guarantee any specific uptime.
9. Third-party services¶
Frogge integrates with third-party services described in the Privacy Policy (Discord, Twitch, FFXIVVenues, and public Lodestone lookups). Your use of those integrations is also subject to those services' own terms, which Frogge doesn't control.
10. Disclaimers and limitation of liability¶
The Service is provided "as is" and "as available", without warranties of any kind, express or implied. We don't warrant that the Service will be uninterrupted, error-free, or that data will never be lost. To the fullest extent permitted by law, Frogge and its operators aren't liable for any indirect, incidental, or consequential damages arising from your use of the Service, including loss of data, revenue, or Discord server access.
11. Termination¶
You can stop using the Service at any time by removing the bot from your server, deleting the Dashboard's OAuth authorization in your Discord settings, and/or unlinking the Plugin. We may suspend or terminate access for any account or server that violates these Terms.
12. Changes to these Terms¶
We may update these Terms as the Service evolves. Material changes will be reflected by an updated effective date on this page. Continuing to use the Service after a change means you accept the updated Terms.
13. Governing law¶
These Terms are governed by the laws of the United States, without regard to conflict-of-law principles, except where local law requires otherwise.
